Welcome to Aria. These Terms of Use ("Terms") govern your use of the Aria application ("App") provided by Synthetic Insights LLC ("we," "us," or "our"). By using Aria, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using Aria, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old to use Aria. If you are under 18, you must have parental or guardian consent.

3. Account Registration

Some features may require you to create an account. You are responsible for:

• Providing accurate information
• Maintaining the security of your account
• All activities under your account

4. Permitted Use

You may use Aria for personal, non-commercial purposes. You agree not to:

• Use the App for illegal purposes
• Attempt to reverse engineer or modify the App
• Interfere with the App's operation
• Share your account with others
• Use the App to harass, abuse, or harm others

5. Healthcare Data Access (Epic MyChart Integration)

5.1 Authorization and Consent

When you connect Aria to your Epic MyChart account or other healthcare providers:

• You authorize Aria to access your electronic health information (EHI) through secure FHIR R4 APIs
• You consent to the retrieval and local storage of your health records on your device
• You acknowledge that this access is governed by both these Terms and your healthcare provider's policies
• You may revoke this authorization at any time through the App settings or your healthcare provider's patient portal

5.2 Types of Health Data Accessed

With your authorization, Aria may access the following health information:

• Demographics: Name, date of birth, contact information
• Clinical Data: Diagnoses, conditions, medical history
• Medications: Current and past prescriptions
• Lab Results: Laboratory test results and observations
• Vital Signs: Blood pressure, heart rate, temperature, etc.
• Allergies: Known allergies and adverse reactions
• Immunizations: Vaccination records
• Procedures: Past and scheduled procedures
• Clinical Notes: Provider documentation and summaries
• Encounters: Visit history and appointments

5.3 Data Processing and Storage

Your healthcare data is:

• Processed locally: All AI analysis of your health data occurs on your device
• Stored securely: Health records are encrypted and stored only on your device
• Never sold: We do not sell or share your health data with third parties for marketing
• Your property: You can export or delete your health data at any time

5.4 Healthcare Provider Requirements

Access to health records through Epic MyChart requires:

• An active patient portal account with a participating healthcare organization
• Authentication through your healthcare provider's secure login
• Compliance with your provider's terms of use and privacy policies

5.5 Limitations of Healthcare Features

You acknowledge and agree that:

• Aria's health features are for informational purposes only
• Aria does not provide medical advice, diagnosis, or treatment recommendations
• Health data displayed may not reflect real-time information
• You should always verify health information with your healthcare provider
• In case of a medical emergency, contact emergency services immediately

6. Intellectual Property

Aria and its content, features, and functionality are owned by Synthetic Insights LLC and are protected by copyright, trademark, and other intellectual property laws.

7. User Content

You retain ownership of content you create or share through Aria. By using the App, you grant us a limited license to process this content as necessary to provide the service.

8. Privacy

Your use of Aria is subject to our Privacy Policy, which explains how we collect, use, and protect your information, including healthcare data.

9. Subscriptions and Payments

Some features may require a paid subscription. Subscription terms, pricing, and billing will be clearly presented before purchase. Subscriptions are managed through Apple's App Store.

10. Disclaimers

Aria is provided "as is" without warranties of any kind. We do not guarantee that:

• The App will be uninterrupted or error-free
• Results from the App will be accurate or reliable
• The App will meet your specific requirements
• Healthcare data will always be complete or up-to-date

11. Limitation of Liability

To the maximum extent permitted by law, Synthetic Insights LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Aria, including but not limited to:

• Decisions made based on health information displayed in the App
• Incomplete or delayed health record synchronization
• Interruptions in access to healthcare provider systems
• Errors in data transmission or display

12. HIPAA Acknowledgment

While Aria implements strong security measures to protect your health information, you acknowledge that:

• Synthetic Insights LLC is not a HIPAA "covered entity" or "business associate"
• Your healthcare providers remain responsible for HIPAA compliance regarding your medical records
• We implement industry-standard security practices to protect your data
• You are responsible for maintaining the security of your device

13. Indemnification

You agree to indemnify and hold harmless Synthetic Insights LLC from any claims arising from your use of the App or violation of these Terms.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use after changes constitutes acceptance.

15. Termination

We may suspend or terminate your access to Aria at any time for violation of these Terms. You may stop using the App at any time. Upon termination, your locally stored health data remains on your device until you delete it.

16. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the applicable jurisdiction.
